• Prevention of Illegal Sand Mining

  River Sand Mining in Kerala is controlled and regulated by the provisions of Kerala Protection of River Banks and Regulations on Removal of Sand Act-2001 and Rules 2002. As per Section 23 of Kerala Protection of River Banks and Regulations on Removal of Sand Act- 2001 (KPRBRRSA-2001) an officer from the Revenue Department not below the rank of Village Officer or a Police Officer not below the rank of a Station House Officer to seize tools, implements, loading equipment's, vehicles, and other articles used or intended to be used for illegal sand mining, including sand. Squad Activity is done at the taluk level 24x7 to prevent illegal sand mining. As per Section 20 of KPRBRRSA-2001, whoever contravenes any of the provisions of this Act or Rules made thereunder shall, on conviction be punished with imprisonment for a term which may extend to two years or with a fine which may extend to twenty-five thousand rupees or with both and in case of continuing contravention with an additional fine which may extend to one thousand rupees for every day during which such contravention continues. Kerala Legislature has amended the above provision of Kerala Protection of River Banks and Regulations on Removal of Act-2001 in 12.12.2022 and increased the penalty amount against illegal sand mining from Rs.25000/- to Rs.5,00,000/- and additional fine amount for continued contravention from Rs.1000/- per day to Rs.5000/- per day.

  2001-ലെ കേ രള നദീ തീ ര സം രക്ഷണവും മണൽവാ രൽ നി യന്ത്ര ണവും നി യമവും 2002-ലെ ചട്ടങ്ങള്‍ എന്നി വയി ലെ വ്യ വസ്ഥകളു ടെ അടിസ്ഥാ നത്തിലാ ണ് സം സ്ഥാ നത്ത് അനധി കൃ ത ആറ്റു മണൽ ഖനനം നി യന്ത്രി ക്കുന്നത്. 2001-ലെ കേ രള നദീ തീ ര സം രക്ഷണവും മണൽവാ രൽ നി യന്ത്ര ണവും നി യമം വകു പ്പ് (23) പ്ര കാ രം അനധി കൃ തമാ യി മണൽ വാ രു കയോ കടത്തികൊ ണ്ടു പോ വു കയോ ചെ യ്യു ന്നപക്ഷം റവന്യൂ വകു പ്പി ലെ വി ല്ലേ ജ് ഓഫീ സറു ടെ പദവി യി ൽ താ ഴെ യല്ലാ ത്ത ഒരു ഉദ്യോ ഗസ്ഥനോ , സ്റ്റേ ഷൻ ഹൗ സ് ഓഫീ സറു ടെ പദവി യി ൽ താ ഴെ അല്ലാ ത്ത ഒരു പോ ലീ സ് ഉദ്യോ ഗസ്ഥനോ , പ്ര ത്യേ ക സം രക്ഷണ സേ നയി ലെ ഒരം ഗത്തിനോ അനധി കൃ ത മണൽ വാ രൽ പ്ര വർത്തനങ്ങൾക്ക് ഉപയോ ഗി ച്ചതോ ഉപയോ ഗിക്കാ ൻ ഉദ്ദേ ശി ച്ചതോ ആയ പണി യാ യു ധങ്ങൾ, വാ ഹനങ്ങൾ, എന്നി വ പി ടിച്ചെ ടുക്കാ നു ള്ള അധി കാ രമു ണ്ട്. 2002-ലെ നദീ തീ ര സം രക്ഷണ ചട്ടങ്ങളി ലെ ചട്ടം നമ്പർ 9(യു ) പ്ര കാ രം അനധി കൃ ത മണൽവാ രൽ തടയു ന്നതി ന് തഹസി ൽദാ ർമാ രു ടെ നേ തൃ ത്വത്തില്‍ പോ ലീ സി ന്റെ യും മറ്റു ഉദ്യോ ഗസ്ഥരു ടെ യും സ്ക്വാ ഡ് 24 മണി ക്കൂറും പ്ര വര്‍ത്തിക്കുന്നുണ്ട്. 2001-ലെ കേ രള നദീ തീ ര സം രക്ഷണം വകു പ്പ് 20 പ്ര കാ രം പ്ര സ്തു ത നി യമമോ അതി ൽ കീ ഴി ലു ണ്ടാ ക്കിയി ട്ടുള്ള ഏതെ ങ്കി ലും ചട്ടങ്ങളോ ലം ഘിക്കുന്നത് കു റ്റകരമാ ണ്. കൂ ടാതെ വകു പ്പ് 21 പ്ര കാ രം പ്ര സ്തു ത നി യമങ്ങളു ടെ യും ചട്ടങ്ങളു ടെ യും കീ ഴി ൽ ശിക്ഷിക്കപ്പെ ടാവു ന്ന ഏതെ ങ്കി ലും കു റ്റം ചെ യ്യാ ൻ പ്രേ രി പ്പിക്കുകയോ അല്ലെ ങ്കി ൽ അത്തരം കു റ്റം ചെ യ്യാ ൻ ശ്ര മി ക്കുകയോ ചെ യ്യു ന്നതും കു റ്റകരമാ ണ്. പ്ര സ്തു ത കു റ്റകൃ ത്യങ്ങളി ൽ ഏര്‍പ്പെ ടുന്നവർക്കുള്ള ശിക്ഷ സെ ക്ഷൻ 20 പ്ര കാ രം വ്യ വസ്ഥ ചെ യ്തി ട്ടുണ്ട്. 2022-ലെ പ്ര സ്തു ത നി യമ ഭേ ദഗതി അനു സരി ച്ച് അനധി കൃ ത മണല്‍ വാ രൽ പ്ര വർത്തനങ്ങളി ൽ ഏർപ്പെ ടുന്ന ഏതൊ രാ ളി നും രണ്ടു വർഷം വരെ യു ള്ള തടവു ശിക്ഷയോ 5 ലക്ഷം രൂ പ വരെ യു ള്ള പി ഴ ശിക്ഷയോ അല്ലെ ങ്കി ൽ ഇവ രണ്ടും കൂ ടിയു ള്ള ശിക്ഷയോ ലഭി ക്കുന്നതാ ണ്. നി യമലം ഘനം തു ടരു ന്ന സാ ഹചര്യത്തിൽ ഓരോ ദി വസത്തിനും 50000 രൂ പ അധി ക പി ഴയും കൊ ടുക്കേ ണ്ടതുണ്ട്.

• Encroachment

  THE KERALA LAND CONSERVANCY ACT,1957 All Officers of the Land Revenue Department shall have it as their primary duty to prevent unauthorised occupation of lands which fall under any of the descriptions given in the definitions of ‘property of Government’ and Poramboke in Section 3 and Section 4 of the Act. The Village Officer , shall report to the Collector promptly all cases of encroachments of porombokes and on lands which are the property of Government other than porombokes, in Form A appended to these rules. The report shall be accompanied by a plotted sketch drawn to scale of the encroachment and a Mahazar containing full particulars of the land encroached upon, such as period of occupation, nature and value of improvements, if any, made of the land, the position of the land with reference to adjoining lands etc. If any officer of the Land Revenue Department of and above the rank of Village Officer detects timber, earth,metal, laterite,sand,lime- shell or such other article of value,involved in unauthorised removal from Government land,such article shall be seized by him and taken under Government custody to be disposed of under the orders of the Collector. In such cases he shall prepare a mahazar giving the full particulars of the article so seized and shall as soon as may be, make a report of such seizure to the Tahsildar or the Taluk accompanied by a statement in Form ‘AA’ appended to these rules. The articles so seized shall be kept in custody or handed over for safe custody to a reliable third person and a receipt obtained therefor. When reports in Form A under Rules 4 and 5 are received, the Collector shall inspect the land and satisfy himself that there is encroachment,before proceeding to deal with the case under the Act. Notice in Form B shall be served by delivering a copy to the person reported to be in unauthorised occupation of the land, or to his authorised agent, or some adult member of his family residing with him,who shall be required to sign an acknowledgement of service endorsed on the original notice. The final order of the Collector shall contain the reasons for the decision. The decision shall be communicated to the party in writing and simultaneously a notice in Form C appended to these rules shall be served on him requiring him to vacate the land within specified period.

• Tree Cutting

  The Kerala Land Assignment Rules,1964 Section 10(3) discribes that the assignee shall also be liable to pay the value of the trees, plants and [vines] if any, specified in Parts A and B of Appendix III to these rules standing on the land [at the time of assignment] at such rates as may by order, be specified by Government and subject to the following conditions:- [(a) No value shall be charged in respect of trees the girth of which is 90 c.m. or less at breast height]." (b) If the assignee was already in occupation of the land and he or his predecessor in occupation has planted trees etc. thereon, no tree value shall be charged in respect of such of those trees etc., planted by him or his predecessor in occupation as are specified in Part B of Appendix III to these rules]. (c) If the assignee is not agreeable to pay the tree value as specified in Clause (a), in respect of trees specified in Part A of Appendix III (65 numbers), to the Tahsildar shall dispose of, in public auction, the trees growth [which is not allowed free to the assignee under that clause] Assignment of Land within Municipal and Corporation Areas rules 1995 under this act Preservation of trees has been discribed section 15 (1) In the case of trees standing on the land assigned as house sites, the assignee shall be permitted to cut and remove the trees on payment of value as estimated by the Assigning Authority: Provided that, where the assignee proves that the trees were planted by the assignee himself or his predecessor-in-interest, no tree value shall be realised. (2) If the assignee is not willing to remit the value, the Assigning Authority shall sell the trees in public auction and remit the amount into Government account. (3) In the case of land assigned on lease, the trees standing thereon shall be the property of Government. The lessee shall cut and remove such trees that are essentially required to be removed for the smooth running of shops, etc. on payment of the value thereof. However, the provisions of the Kerala Preservation of Trees Act, 1986 shall be applicable in the case of valuable trees. As per the Government order no.261/2020/REV dated 24/10/2020 has given permission to cut trees except sandle wood to assignee. In 2021Government has cancelled the above mentioned government order (261/2020/REV dated 24/10/2020)as per 30/2021/REV dated 02/02/2021

(1) വീ ടു വയ്ക്കു ന്നതി ലേ യ്ക്കാ യി പതി ച്ചു നൽകി യി ട്ടു ള്ള ഭൂ മി യി ല്‍ൽ നി ൽക്കു ന്ന വൃക്ഷങ്ങളെ സം ബന്ധിച്ചി ടത്തോ ളം പതി ച്ചു നൽകൽ അധി കാ രകേ ന്ദ്രം മതി പ്പു കണക്കാ ക്കു ന്ന വി ല നൽകി കൊ ണ്ട് മരങ്ങൾ മു റി ച്ച് നീക്കം ചെ യ്യു ന്നതി ന് പതി ച്ച കി ട്ടി യ വ്യക്തിയെ അനു വദിക്കു ന്നതാ ണ്. എന്നാ ൽ പതി ച്ചു കി ട്ടി യ വ്യക്തിയോ അയാ ളു ടെ മു ൻഗാ മി യോ ആണ് മരങ്ങൾ വച്ചു പി ടി പ്പി ച്ചതെ ന്ന് തെ ളി യിക്കു ന്നപക്ഷം അവയു ടെ വി ലഈടാ ക്കു ന്നതല്ല. • Mineral Mining

  Mining and development of minor minerals is controlled by the Central government act Mines & Minerals Mineral (Development & Regulation) Act 1957. In exercise of the powers conferred by this Act the Government of Kerala made the Kerala Minor Mineral Concession Rules 2015 . The permission for mining has given by Director ,Mining & geology Department. The No Objection certificate for mining Minor minerals from Government land has given from the Revenue Department. The District Collectors concerned is the authority for giving the NOC for mining. Based on the Government Order G O (MS) 28/2021 Dated 28/01/2021 the the process of giving NOC for mining of minor minerals from Government land must be in E-Auction manner . In certain conditions No Objection Cerrtificate from Revenue Divisional Officer has needed for the mining of minor minerals from the registered land .As per the section 21(4) of MMDR Act 1957 any Revenue officer above the rank of Village Officer to District Collector can seize the equipments and vehicles used for illegal mining & transportation of minor minerals from any land .
